Our firm also provides title insurance for real estate and mortgage transactions as agent for Lawyers Title Insurance Corporation. We also have extensive experience in foreclosures of both residential and commercial mortgages.

Our firm provides an extensive range of services for businesses from start up, acquisition, operations, through sale or dissolution. We assist the business owner with choice of entity type, entity formation, ownership transfer agreement, mergers and acquisitions, contracts, employment issues, owner dispute and deadlock situations and dissolution proceedings. Our experience includes corporations, limited liability companies, not-for-profits, partnerships, joint ventures and entities for licensed professionals.

Litigation

Our firm maintains an active civil litigation practice.  We represent clients in a wide variety of litigation matters in the municipal, state appellate and federal courts.  Our civil litigation practice includes bankruptcy, construction, contract, creditor rights, estate, matrimonial, municipal, personal injury, foreclosures, real estate, real property tax and torts.

We work with our clients on all stages of the litigation process from pleadings and motion practice through trial and appeal.  We also pursue alternative dispute resolution mehtods of arbitration, mediation and negotiation to achieve optimal results for our clients.

Estates, Wills & Trusts

A major portion of the Firm's practice relates to estates, wills, and trusts, including all necessary planning and document preparation required for complete representation in these areas.  We prepare wills, trusts (revocable and irrevocable living trusts, and testamentary trusts), durable powers of attorney, living wills and health care proxies.  We provide a full range of services to assist executors and trustees in carrying out their fiduciary duties in the administration of both estates and trusts, including preparation of estate tax returns and fiduciary income tax returns.

Our attorneys render service and advice in connection with guardianships and special needs trusts for individuals and their families requiring special needs planning and services. 

Elder Law

The firm provides representation to our senior citizens in areas of concern to them and their families, including: asset and medicaid planning; preparation of durable powers of attorney, living wills and health care proxies; guardianship under the New York Mental Hygiene Law.  We counsel senior citizens regarding retirement, asset and financial planning issues of all kinds.  Several of our attorneys are members of the National Academy of Elder Law Attorneys.

Family & Matrimonial Law

Our firm represents clients in all aspects of Family Law, including, divorce, custody and child suport proceedings as well as the negotiation of comprehensive marital settlement agreements and pre-nuptial agreements.  We have developed an expertise in the many complex issues which may arise in family law cases. 

Workers' Compensation

Workers' Compensation is a system of laws designed to protect workers who suffer on the job injuries.  For years our firm has represented claimants covered under workers compensation in obtaining the maximum benefits they are entitled to under the law.  Our firm is located in the same building as the New York State Workers' Compensation Office for Cayuga County.

Personal Injury

From our firm's inception, our lawyers have handled cases involving motor vehicle accidents, construction workplace accidents involving the New York Labor Law, product liability claims, and other compex cases seeking damages for personal injury.  We are proud of our record of achievement and our tradition of honest, hard, and effective advocacy.

Immigration

The immigration law of the United States provides the framework for the admission to the U.S. of citizens from other countries, the duraction and conditions of their stay and the procedures for the removal of foreign citizens who are unauthorized to be in the U.S. The law sets forth the requirements to be admitted to the U.S. as a non-immigrant, as a legal permanent resident and to become a naturalized U.S. citizen.

Immigration law has grown into a complex set of standards and requirements.  Attorney Robert K. Bergan has practiced in this area for over twenty five years.  He has represented individuals and employers confronting immigration issues, focusing primiarily upon: Family immigration including immigrant visa petitions and applications for legal permanent residence; and Business immigration including temporary professional work visa and immigrant visas. 

Mr. Bergan is a member of the American Immigration Lawyers' Association.

Bankruptcy

The Bankruptcy laws of the United States give individuals and businesses struggling with financial difficulties an opportunity to wipe the slate clean and start over.  The law offers debtors relief from creditors and a chance to analyze and improve their financial circumstances.

In October 2005, the Bankruptcy Code changed drastically.  The new law limits the number of individuals eligible to file Chapter 7, imposes stricter filing requirements and requires consumer credit counseling.  Our attorneys have the expertise and experience to represent debtors in Chapter 7 and Chapter 13 cases and offer an initial free consultation.

Trademark & Copyright

In today's gobal and computerized economy, Trademark and Copyright laws offer clients invaluable protection against the unauthorized use by others of their marks or works.  Trademark law protects distinctive marks whereas Copyright law protects the fizxed original expression of ideas.

Registration of trademarks and copyrights is a complex process, which requires a fundamental legal understanding of what kind of a mark/work is being used, how the mark/work is being used, who created the mark/work, whether the mark/work is already in use elsewhere and whether it is protectable.  Trademark and Copyright litigation is even more complicated and requires knowlege of what constitutes infringement, whether any such infringement is actionable and what remedies or damages may be available.
